Open skies agreement expands the air market between Brazil and Argentina

The framework of meetings between the Brazilian National Civil Aviation Agency (ANAC) and the Argentine National Civil Aviation Administration (ANAC), which took place on March 6 and 7, was signed between the director-president of ANAC Brasil, Tiago Pereira, and his Argentine counterpart, Gustavo Marón, Memorandum of Understanding that establishes the open skies policy in the air market between Brazil and Argentina, putting an end to weekly limits on regular passenger flights and facilitating the release of cargo flights.

With the signing of the instrument, Brazilian and Argentine airlines will be able to freely determine the number of passenger flights they intend to offer between the two countries. Until then, companies on each side were limited to offering, together, a maximum number of 170 weekly flights, according to each country's regulations. The measure will give companies more flexibility to plan their operations, which could lead to an increase in the supply of services and increased competition on routes connecting Brazil and Argentina.   

The Memorandum also expands permission for cargo service operations, allowing airlines from both countries to transport international cargo without the requirement that the operation begin or end in the company's country of origin (rights known in the sector as “Seventh Freedom of the Air”). Recently, in addition to the instrument with Argentina, Brazil negotiated similar rights for cargo in the region with Chile, Costa Rica, Cuba, Panama, Paraguay, Peru, Dominican Republic, Uruguay and Venezuela.

The instrument also recognizes the need to renegotiate the agreement on bilateral air services, to consolidate the advances achieved and update the bilateral legal framework in the sector, which is currently governed by an agreement signed in 1948. Such results are the result of joint efforts between the Ministry of Foreign Affairs (MRE), the Ministry of Ports and Airports (MPor) and the National Civil Aviation Agency (ANAC).
